1.2 The Customer is the business organisation or sole trader that orders the service in the course of its trade or profession. A consumer (a natural person acting outside their trade, business or profession) may not use the service. When ordering, the Customer gives its tax number wherever the checkout page asks for it in the Customer's country, and by ordering declares that it is not acting as a consumer.
2. Definitions
- Service: the Bitecard web application and its public menu page, as described in section 3.
- Customer: the business described in section 1.2.
- Account: the Customer's access to the Service's admin app.
- Account owner: the person who created the Account on the Customer's behalf and who manages the subscription.
- Staff member: a person the Account owner invites to the Account.
- Plan: the content and price of the subscription, as shown on the website and the checkout page.
- Customer content: all data, text and images that the Customer or its Staff members upload to the Service, including menus, restaurant details and photos.
- End user: a guest of the Customer, or anyone else, who views the public menu page.
3. The service
3.1 Bitecard is a menu service for restaurants. In the admin app the Customer:
- builds a weekly menu by day and course, with prices, descriptions, allergens and dish photos, and publishes it for a period;
- keeps a standing menu of dishes available every day;
- fills in the restaurant page: name, logo, cover image, address, opening hours, contact details, social pages, introduction, gallery;
- publishes the menu on the restaurant's own public page at
/<identifier>/menu, which guests can view without signing in; - may invite up to three Staff members to edit the menus;
- can see how many times the menu page was opened;
- can download its data at any time in a machine-readable format (JSON).
3.2 The public menu page is available only while a subscription is valid. When the subscription ends, the menu page becomes unavailable.
3.3 One subscription covers one restaurant and three Staff member seats.
4. Conclusion of the contract
4.1 The contract is concluded in these steps:
- The Customer chooses monthly or annual billing on the website, or builds a menu draft on the try page (/try) and claims it.
- The Customer enters its email address.
- On Stripe's checkout page the Customer enters its billing details (name, address, and a tax number where the checkout page asks for one) and card details, and accepts these Terms by ticking the checkbox.
- The contract is concluded on successful payment. The Provider creates the Account and sends a sign-in link to the email address given.
4.2 Correcting input errors: before submitting payment, the Customer can check and correct every detail on Stripe's checkout page, or go back. After payment, billing details can be changed through Stripe's customer portal under Settings → Subscription.
4.3 The contract is concluded electronically. The Provider confirms the order with the sign-in link sent to the email address given.
4.4 The contract is not a written contract. The Provider does not file it, but records with the subscription which version of the Terms the Customer accepted and when. The Terms in force are available at https://bitecard.app/en/landing/terms, and the Provider sends earlier versions on request.
4.5 The contract may be concluded in Hungarian or English (see section 17).
5. Account and staff
5.1 An Account may be created by a person authorised to act on the Customer's behalf.
5.2 Sign-in is passwordless, by a one-time link sent to the email address. The Customer is responsible for keeping the email accounts linked to the Account safe from unauthorised access. If it notices unauthorised access, it must tell the Provider without delay.
5.3 The Account owner may invite up to three Staff members. The Customer is liable for its Staff members' actions as if they were its own.
6. Fees and payment
6.1 The Plan's content and fee are shown on the website and the checkout page. Fees are net amounts, to which VAT at the rate in force is added. Stripe shows the tax on the checkout page.
6.2 The fee is payable monthly or annually in advance, depending on the billing period chosen.
6.3 The subscription renews automatically at the end of each period until the Customer or the Provider ends it (section 13).
6.4 Payment is by card, through Stripe. The Provider neither sees nor stores card details.
6.5 The Provider issues an electronic invoice for every payment through Számlázz.hu. The Customer can download invoices under Settings → Subscription.
6.6 If a payment fails, Stripe retries the charge and the Provider notifies the Customer by email. For late payment, the Provider may charge default interest under the Civil Code and may suspend the Service under section 12.
7. Acceptable use
The Customer may not upload or publish through the Service any content that:
- breaks the law or promotes unlawful activity;
- infringes another person's copyright, trade mark or other rights, in particular a photo the Customer has no right to use;
- contains the image or data of a person who has not consented and whose data cannot lawfully be published on another basis;
- is misleading about prices, ingredients or allergens;
- is hateful, offensive or violent.
The Customer may not attempt to overload the Service, circumvent its security measures, access another Customer's data, or download the Service in bulk by automated means.
8. Customer content, reports and removal
8.1 Customer content belongs to the Customer. The Customer is responsible for the content being correct and for holding every right needed to upload and publish it. The menu's prices, ingredients and allergens are the Customer's responsibility.
8.2 For the term of the contract, the Customer grants the Provider a non-exclusive, royalty-free licence to store, process and display Customer content on the public menu page, solely to provide the Service.
8.3 Reporting: anyone who finds content on a public menu page that they consider illegal can report it with the "Report this page" link in the page footer, or by email to abuse@bitecard.app. The report must give the page address, the content concerned (dish, text or photo), why the reporter considers it illegal, the reporter's name and email address, and a statement that the report is made in good faith and is accurate and complete.
8.4 The Provider acknowledges receipt of a report within 2 working days, examines it without undue delay, and tells the reporter its decision, including the option of contacting the National Media and Infocommunications Authority (NMHH) as Digital Services Coordinator. If the Provider removes or disables access to content, it notifies the Customer by email with a statement of reasons: what was restricted and from when, the facts and the legal provision or clause of these Terms the decision is based on, that the decision was not taken by automated means, and how to contest it. The Customer may contest it by replying to that email, and may also turn to a court or an out-of-court dispute settlement body.
8.5 The Provider does not check Customer content in advance.
9. Data protection
9.1 The Provider describes its own processing of personal data in its Privacy policy (https://bitecard.app/en/landing/privacy-policy).
9.2 Where the Provider processes personal data on the Customer's behalf, the Data processing agreement (https://bitecard.app/en/landing/dpa) applies. That agreement forms part of these Terms and is concluded by accepting them.
9.3 In case of conflict, the Data processing agreement prevails on the processing of personal data on the Customer's behalf, the prices shown on the website and the checkout page prevail on the amount of the fees, and these Terms prevail on everything else. The Privacy policy is information, not part of the contract.
10. Availability
10.1 The Provider makes reasonable efforts to keep the Service running, but commits to no specific availability.
10.2 The Provider announces planned maintenance in advance, by email or in the app.
11. Liability
11.1 The Provider's liability for damage caused by breach of contract is limited to the fees the Customer paid in the 12 months before the event causing the damage.
11.2 The Provider is not liable for indirect damage or lost profit.
11.3 Sections 11.1 and 11.2 do not apply to damage caused intentionally or by gross negligence, or to a breach of contract that harms human life, physical integrity or health (Section 6:152 of the Civil Code).
11.4 The Provider is not liable for the correctness or lawfulness of Customer content.
12. Suspension
12.1 If the Customer's payment is more than 14 days overdue, the Provider may, after a written (email) reminder, suspend the Service, including the public menu page, until the debt is settled.
12.2 If the Customer breaches section 7 in a way that endangers others, the Provider may suspend the Service immediately and will tell the Customer the reason.
13. Termination
13.1 The Customer may end the subscription at any time under Settings → Subscription. The termination takes effect at the end of the period already paid. No refund is given for the remaining time. If the Customer deletes its Account under Settings → Danger zone, the contract and the subscription end immediately, the public menu page becomes unavailable, and no refund is given for the rest of the paid period. A Customer who wants to use the time it has paid for should first cancel the subscription and delete the Account at the end of the period.
13.2 The Provider may terminate the contract by email with 30 days' notice. It then refunds, pro rata, any fee already paid for the time after the termination takes effect. For a material breach the Provider may terminate with immediate effect, and then gives no refund.
13.3 On termination, the public menu page becomes unavailable. The Customer can still download its data after signing in. On the 30th day after termination the Provider warns the Account owner by email of the coming deletion, and on the 60th day, but never less than 30 days after the warning, it deletes the Account, the Customer content and the uploaded images. Invoices and billing data are kept for 8 years as the accounting rules require.
14. Changes to the Terms and fees
14.1 The Provider may change these Terms unilaterally. It notifies the Customer by email at least 30 days before a change takes effect.
14.2 The Provider gives at least 30 days' notice of a fee change by email. The new fee applies from the next billing period.
14.3 A Customer that does not accept a change may, before it takes effect, terminate the contract by email to support@bitecard.app with effect from the day before the change applies. The Provider then refunds, pro rata, any fee already paid for the time after the termination takes effect. A Customer that does not terminate by then and keeps using the Service is deemed to accept the change.
15. Contact and complaints
15.1 Customers reach the Provider at support@bitecard.app.
15.2 The single point of contact for End users and authorities (Articles 11 and 12 of Regulation (EU) 2022/2065) is abuse@bitecard.app. Reports under section 8.3 go to the same address. Communication is in Hungarian or English.
15.3 The Provider answers complaints and enquiries within 30 days.
16. Governing law and jurisdiction
16.1 The contract is governed by Hungarian law, in particular Act V of 2013 on the Civil Code and Act CVIII of 2001 on electronic commerce services.
16.2 The parties agree that the competent court for the Provider's seat has exclusive jurisdiction over their disputes.
17. Language versions
These Terms are available in Hungarian and English. If they differ, the Hungarian version prevails.
